Sexual Ambiguities

On the other hand, this really is a horrible country a lot of the time..

So on Monday it was revealed by the Australian that nine males found guilty of raping a ten year old indigenous girl in Queensland were either given suspended sentences or probation. The judge, Justice Sarah Bradley, ruled that the girl had "probably" agreed to have sex.

The prosecutor, too, described the males involved as "naughty." Why didn't he just say, "boys will be boys" and then give them all a high-five? I hope he is fired. And then shot. He said to the court:

"My submission in relation to this particular offence (rape) is the same that I make in relation to children of that age - of similar or the same age - is to quote, well, they're very naughty for doing what they're doing but it's really, in this case, it was a form of childish experimentation rather than one child being prevailed upon by another."

Now, three of the offenders were 17, 18 and 26. HOW THE FUCK is that childish experimentation? Nine boys and men, one ten year old girl, and she's not being prevailed upon?

In the Age, the comments of Justice Bradley were swiftly condemned by prominent Brisbane-based Aboriginal academic Professor Boni Robertson, who called for her to step down.

"'It's actually undermined everything we have worked for over the last 10 years to get our women justice in this country,' Prof Robertson told reporters in Brisbane. There is something even more sinister - it's actually given a very clear message to perpetrators out there generally. I don't care that they are black, white or whatever. I think it's allowed perpetrators to think if you can come up with a defence that she asked for it or she condoned it, then that gives them a sense of leniency."

As Firefly asks, when is rape not rape? When it happens to indigenous women.

As an outsider, I wouldn't judge Australia by this--we have enough bigoted idiot judges and lawyers over here in America!

That said, I'm glad there's a response going on, and I hope Justice Sarah Bradley, the prosecutor, and the rapists themselves all get exactly what they deserve. That little girl deserves justice.
